Welcome to Profelio! These Terms of Use ("Terms") constitute a binding legal agreement between you ("User," "you," or "your") and Profelio ("Profelio," "we," "us," or "our"). These Terms govern your access to and use of the Profelio website, website builder, hosting services, and any related features or content (collectively, the "Services").

By accessing or using Profelio, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.

1. Eligibility and Account Registration

1.1 Eligibility

You must be at least 13 years old (or the minimum legal age in your country) to use our Services. If you are registering on behalf of a business or legal entity, you represent that you have the authority to bind that entity to these Terms.

1.2 Account Security

To access certain features, you must register for an account. You are responsible for maintaining the confidentiality of your login credentials. You are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2. Your Use of the Services

2.1 License to Use

Subject to these Terms, Profelio grants you a limited, non-exclusive, non-transferable, and revocable license to use our Services to build, host, and manage websites ("User Sites").

2.2 Prohibited Conduct

You agree not to use the Services to:

• Violate any applicable national or international laws.
• Publish content that is unlawful, defamatory, obscene, infringing, or fraudulent.
• Distribute viruses, malware, or any other harmful computer code.
• Send unsolicited advertising or spam.
• Attempt to reverse engineer, decompile, or hack the Profelio platform.
• Host content that promotes violence, discrimination, or illegal acts.

3. User Content and Ownership

3.1 Your Content

You retain full ownership of all text, images, videos, code, and other materials you upload or create using Profelio ("User Content"). We do not claim ownership of your User Content.

3.2 License to Profelio

By using the Services, you grant Profelio a worldwide, royalty-free, non-exclusive license to host, store, cache, reproduce, and display your User Content solely for the purpose of providing the Services to you and ensuring the proper operation of your User Site.

3.3 Responsibility for Content

You are solely responsible for your User Content and the consequences of publishing it. Profelio does not actively monitor User Content but reserves the right (though not the obligation) to remove any content that violates these Terms.

4. Profelio Intellectual Property

The Profelio platform, including its code, documentation, appearance, structure, templates, and trademarks, is the exclusive property of Profelio and its licensors. You agree not to copy, modify, or create derivative works of our proprietary technology.

5. Fees and Payments

5.1 Subscriptions

Certain aspects of the Services may require a fee ("Paid Services"). You agree to pay all fees associated with your selected subscription plan.

5.2 Billing and Renewal

Subscription fees are billed in advance on a recurring basis (monthly or annually). Your subscription will automatically renew at the end of each billing cycle unless you cancel it.

5.3 Refunds

If you are not satisfied with the Services, you may request a refund within 14 days of your initial purchase.

6. Termination

6.1 Termination by You

You may terminate these Terms at any time by canceling your account within your dashboard. Upon cancellation, your User Site may be taken offline immediately.

6.2 Termination by Us

We reserve the right to suspend or terminate your account at our discretion, without notice, if you violate these Terms, or if we are required to do so by law.

7. Disclaimers and Limitation of Liability

7.1 "As Is" Basis

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Profelio expressly disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or error-free.

7.2 Limitation of Liability

To the fullest extent permitted by law, Profelio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of or inability to use the Services. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Third-Party Services

Profelio may allow you to integrate with third-party services (e.g., payment gateways like Stripe/PayPal, analytics tools, domain registrars). Your use of these third-party services is governed by their respective terms and policies. We are not responsible for the content or practices of third-party services.

9. DMCA / Copyright Policy

We respect the intellectual property rights of others. If you believe that material located on or linked to by Profelio violates your copyright, please notify us at [email protected]. We will respond to all valid notices in accordance with the Digital Millennium Copyright Act (DMCA).

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Algeria, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
